How do we collect your data?

You directly provide our company with most of the data we collect. This can be data that you enter in a contact form, for example.

Other data is collected automatically or with your consent by our IT systems when you visit the website. These are mainly technical data (e.g. internet browser, operating system, or time of the page call). This data is collected automatically as soon as you enter this website.

How will we use your data?

Part of the data is collected to ensure that the website is provided without errors. Other data can be used to analyse your user behaviour.

What are your data protection rights?

You have the right to receive information free of charge about the origin, recipient, and purpose of your stored personal data at any time. You also have the right to demand the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent for the future at any time. In addition, you have the right to demand the restriction of the processing of your personal data, under certain circumstances. Furthermore, you have the right to appeal to the responsible supervisory authority.

You can contact us at any time regarding this and other questions about data protection.

Analysis tools and third-party tools

When you visit this website, your surfing behaviour can be statistically evaluated. This is mainly done with so-called analysis programs.

Detailed information on these analysis programs can be found in the following data protection declaration.

3. General notes and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and according to the legal data protection regulations as well as this privacy policy.

When you use this website, various personal data is collected. Personal data is data with which you can be personally identified. This privacy policy explains the types of data we collect and what we use it for. It also explains how we do this and for what purpose.

We point out that data transmission over the Internet (e.g. communication by email) can have security gaps. It is not possible to completely protect data from access by third parties.

Note on the responsible party

The responsible party for data processing on this website is:

Bitrock Digital Partners GmbH
Pullacher Str. 11
82049 Pullach i. Isartal
Germany

Telefon: +49 89 41327400
E-Mail: hello (at) bitrock (dot) partners

The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Storage period

Unless a more specific storage period has been specified within this data protection declaration, your personal data will remain with us until the purpose for which it was collected ceases to apply. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, the deletion will take place after these reasons have ceased to apply.

Note on data transfer to the USA

Among other things, our website includes tools from companies based in the USA. If these tools are active, your personal data may be transferred to the US-based servers of these companies. We would like to point out that the USA is not a safe third country in terms of EU data protection law. US companies are obliged to release personal data to security authorities without you as the affected party being able to take legal action against it. Therefore, it cannot be excluded that US authorities (e.g. secret services) may process, evaluate, and permanently store your data on US-based servers for monitoring purposes. We cannot influence these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your explicit consent. You can revoke a previously given consent at any time. The legality of the data processing that took place up to the revocation remains unaffected by the revocation.

Right to object to data collection in particular cases and to direct marketing (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6 (1) (E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR SPECIFIC SITUATION, INCLUDING PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION DECLARATION. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN PROVE THAT THERE ARE COMPELLING REASONS FOR PROCESSING WHICH ARE WORTHY OF PROTECTION AND WHICH OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS OR IF THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION ACCORDING TO ART. 21 (1) GDPR).

IF YOUR PERSONAL DATA ARE PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING, INCLUDING PROFILING, INSOFAR AS IT IS CONNECTED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION ACCORDING TO ART. 21 (2) GDPR).

Right of appeal to the applicable supervisory authority

In the case of violations of the GDPR, the persons concerned have a right of appeal to a supervisory authority, in the member state of their habitual residence, place of work or place of the suspected violation. This right of appeal is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data, which we process automatically on the basis of your consent or in fulfilment of a contract, handed over to you or to a third party in a structured, commonly used and machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done to the extent technically feasible.

SSL- and/or TLS-encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as site operator. You can recognize an encrypted connection by the fact that the address line of your browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If the SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Access, rectification, and erasure

Within the framework of the applicable legal provisions, you have the right to obtain information free of charge at any time about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to rectify or erase this data. Regarding this and for further questions, you can contact us at any time.

Right to restriction of processing

You have the right to request that the processing of your personal data be restricted. You can contact us at any time for this purpose. The right to limit processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. For the duration of the review, you have the right to demand the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can demand the restriction of the data processing instead of deletion.
  • If we no longer need your personal data, but you need it for the exercise, defence or assertion of legal claims, you have the right to demand the restriction of the processing of your personal data instead of deletion.
  • If you have objected following Art. 21 (1) GDPR, a balance must be struck between your interests and ours. If it is not yet clear whose interests prevail, you have the right to demand the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data - apart from its storage - may only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a member state.

4. Data collection on this website

Cookies

Our internet pages use so-called "cookies". Cookies are small text files and do not cause any damage on your end device. They are either temporarily stored on your device for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for the processing of payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies are used to evaluate user behaviour or display advertising.

Cookies that are required to carry out the electronic communication process (necessary cookies) or to provide certain functions that you have requested (functional cookies, e.g. for the shopping basket function) or to optimize the website (e.g. cookies for measuring the web audience) are stored based on Art. 6 (1) (f) GDPR, unless another legal basis is given. The website operator has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of his services. If consent to the storage of cookies has been requested, the storage of the cookies in question will be carried out exclusively based on this consent (Art. 6 (1) (a) GDPR); the consent can be revoked at any time.

You can set the browser settings that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for specific cases or in general and activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the functionality of this website may be limited.

Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you separately about this within the scope of this data protection declaration and, if necessary, request your consent.

Server log files

The provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of these data is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of his website - for this purpose, the server log files must be recorded.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us to process the inquiry and in the event of follow-up questions. We will not pass this data on without your consent.

The processing of this data is based on Art. 6 (1) (b) GDPR if your inquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if this was queried.

The data entered by you in the contact form will remain with us until you request us to delete it, revoke your consent to its storage or the purpose for which it was stored ceases to apply (e.g. after your inquiry has been processed). Mandatory legal provisions - in particular, retention periods - remain unaffected.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your inquiry including all personal data (name, inquiry) will be stored and processed by us to process your request. We will not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) (b) GDPR, if your inquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if this was queried.

The data sent to us by you via contact inquiries will remain with us until you request us to delete it, revoke your consent to its storage or the purpose for which it was stored no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular, legal retention periods - remain unaffected.

5. Social Media

LinkedIn Plugin

Our site uses functions from the LinkedIn network. The service is provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time one of our pages containing LinkedIn features is accessed, your browser establishes a direct connection to the LinkedIn servers. LinkedIn is informed that you have visited our web pages from your IP address. If you use the LinkedIn “Recommend” button and are logged into your LinkedIn account, it is possible for LinkedIn to associate your visit to our website to your user account. We would like to point out that, as the provider of these pages, we have no knowledge of the content of the data transmitted or how it will be used by LinkedIn.

More information can be found in the LinkedIn privacy policy at https://www.linkedin.com/legal/privacy-policy.

6. Analytics and advertising

Google Analytics

This website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called “cookies”. These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Google Analytics cookies are stored based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising.

IP anonymization

We have activated the IP anonymization feature on this website. Your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services regarding website activity and Internet usage for the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with any other data held by Google.

Browser plugin

You can prevent these cookies being stored by selecting the appropriate settings in your browser. However, we wish to point out that doing so may mean you will not be able to enjoy the full functionality of this website. You can also prevent the data generated by cookies about your use of the website (incl. your IP address) from being passed to Google, and the processing of these data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Objecting to the collection of data

You can prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be set to prevent your data from being collected on future visits to this site: Disable Google Analytics.

For more information about how Google Analytics handles user data, see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.

Outsourced data processing

We have entered into an agreement with Google for the outsourcing of our data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic data collection by Google Analytics

This website uses Google Analytics’ demographic features. This allows reports to be generated containing statements about the age, gender, and interests of site visitors. This data comes from interest-based advertising from Google and third-party visitor data. This collected data cannot be attributed to any specific individual person. You can disable this feature at any time by adjusting the ads settings in your Google account or you can forbid the collection of your data by Google Analytics as described in the section “Refusal of data collection”.

Google Analytics Remarketing

Our websites use the features of Google Analytics Remarketing combined with the cross-device capabilities of Google Ads and DoubleClick. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA.

This feature makes it possible to link target audiences for promotional marketing created with Google Analytics Remarketing to the cross-device capabilities of Google Ads and Google DoubleClick. This allows advertising to be displayed based on your personal interests, identified based on your previous usage and surfing behavior on one device (e.g. your mobile phone), on other devices (such as a tablet or computer).

Once you have given your consent, Google will associate your web and app browsing history with your Google Account for this purpose. That way, any device that signs into your Google Account can use the same personalized promotional messaging.

To support this feature, Google Analytics collects Google-authenticated IDs of users that are temporarily linked to our Google Analytics data to define and create audiences for cross-device ad promotion.

You can permanently opt out of cross-device remarketing/targeting by turning off personalized advertising in your Google Account; follow this link: https://www.google.com/settings/ads/onweb/.

The aggregation of the data collected in your Google Account data is based solely on your consent, which you may give or withdraw from Google per Art. 6 (1) (a) GDPR. For data collection operations not merged into your Google Account (for example, because you do not have a Google Account or have objected to the merge), the collection of data is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in analyzing anonymous user behavior for promotional purposes.

For more information and the Google Privacy Policy, go to: https://www.google.com/policies/technologies/ads/.

Google Ads and Google Conversion Tracking

This website uses Google Ads. Ads is an online advertising program from Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, United States (“Google”).

As part of Google Ads, we use so-called conversion tracking. When you click on an ad served by Google, a conversion tracking cookie is set. Cookies are small text files that your internet browser stores on your computer. These cookies expire after 30 days and are not used for personal identification of the user. Should the user visit certain pages of the website and the cookie has not yet expired, Google and the website can tell that the user clicked on the ad and proceeded to that page.

Each Google Ads advertiser has a different cookie. Thus, cookies cannot be tracked using the website of an Ads advertiser. The information obtained using the conversion cookie is used to create conversion statistics for the Ads advertisers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, advertisers do not obtain any information that can be used to personally identify users. If you do not want to participate in tracking, you can opt-out of this by easily disabling the Google Conversion Tracking cookie by changing your browser settings. In doing so, you will not be included in the conversion tracking statistics.

Conversion cookies are stored based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising.

For more information about Google Ads and Google Conversion Tracking, see the Google Privacy Policy: https://www.google.de/policies/privacy/.

You can configure your browser to inform you about the use of cookies so that you can decide on a case-by-case basis whether to accept or reject a cookie. Alternatively, your browser can be configured to automatically accept cookies under certain conditions or to always reject them, or to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

Outfunnel

We use Outfunnel to create email distribution lists and manage marketing campaigns. During those activities, information, such as IP addresses are shared with this third-party service provider. Such processing is covered with a data processing agreement protecting your personal data.

7. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we need an email address from you as well as information that allows us to verify that you are the owner of the provided email address and that you agree to receive the newsletter. Further data will not be collected or only voluntarily. We use these data exclusively for sending the requested information and do not pass them on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 (1) (a) GDPR). You can revoke your consent to the storage of the data, the e-mail address as well as its use for sending the newsletter at any time, e.g. via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you have provided us with to subscribe to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter or after the discontinuation of the purpose. We reserve the right to delete or block email addresses from our newsletter distribution list at our discretion within the scope of our legitimate interest under Art. 6 (1) (f) GDPR.

After you have been removed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in compliance with the legal requirements when sending newsletters (legitimate interest in the sense of Art. 6 (1) (f) GDPR). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

Sendinblue

This site uses Sendinblue's services to send newsletters. The provider is SENDINBLUE - 55 rue d'Amsterdam, 75008 Paris, France.

Sendinblue is a service that allows you to organize and analyse the sending of newsletters, among other things. When you enter information (e.g. email address) to subscribe to the newsletter, that information is stored on Sendinblue's servers.

Sendinblue allows us to analyse our newsletter campaigns. When you open an email sent with Sendinblue, a file contained in the email (called a web beacon) connects to Sendinblue's servers. This allows us to determine whether a newsletter message has been opened and which links have been clicked on if any. Technical information is also collected (e.g. time of retrieval, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not wish to receive analysis from Sendinblue, you must unsubscribe from the newsletter. To do this, we provide a link in each newsletter message. You can also unsubscribe directly on the website.

Data processing is based on your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time by unsubscribing the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

The data you provide us with to subscribe to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from Sendinblue's servers after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g. email addresses for the member area) remains unaffected.

For more information, please refer to Sendinblue's Privacy Policy at https://www.sendinblue.com/legal/privacypolicy/.

Data-Processing-Agreement with Sendinblue

We have a Data Processing Agreement with Sendinblue in which we commit Sendinblue to protect our customers' information and not to share it with third parties.

8. Plugins and Tools

YouTube with enhanced data protection

This website integrates videos from YouTube. This site is operated by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this site before they watch the video. However, the enhanced privacy mode does not necessarily preclude the sharing of information with YouTube partners. For example, YouTube connects to the Google DoubleClick network regardless of whether you are watching a video.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged in to your YouTube account, you allow YouTube to associate your browsing behaviour directly with your profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube can store various cookies on your end device after starting a video or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to gather video statistics, improve the user experience and prevent fraud.

Once a YouTube video is launched, it may trigger other data processing operations over which we have no control.

YouTube is used in the interest of an attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 (1) (f) GDPR. If a corresponding consent has been requested, the processing is carried out exclusively based on Art. 6 (1) (a) GDPR; the consent is revocable at any time.

Further information about data protection on YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”).

reCAPTCHA is used to check whether the data entered on our website (such as on a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the visitor has been on the website, or mouse movements made by the user). The data collected during the analysis will be forwarded to Google.

The reCAPTCHA analyses take place completely in the background. Website visitors are not advised that such an analysis is taking place.

Data processing is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in protecting its site from abusive automated crawling and spam.

For more information about Google reCAPTCHA and Google’s privacy policy, please visit the following links: https://www.google.com/intl/de/policies/privacy/ and https://www.google.com/recaptcha/intro/android.html.
